By using ShopSmith, you agree to these Terms of Service. If you do not agree, do not use the software.

2. Description of Service

ShopSmith is a local-first desktop application that helps Etsy sellers prepare digital product listings. ShopSmith provides:

• Source file management and versioning
• AI-assisted listing content generation (titles, descriptions, tags, mockup images)
• Downloadable upload kits with organized files
• A guided step-by-step workflow for manually publishing listings on Etsy

3. Your Responsibilities

• Etsy compliance: You are solely responsible for ensuring your listings comply with Etsy's Terms of Use, Seller Policy, and all applicable marketplace rules.
• Listing accuracy: You are responsible for reviewing and verifying all AI-generated content before publishing. AI-generated titles, descriptions, tags, and images may contain errors or inaccuracies.
• Intellectual property: You are responsible for ensuring you have the rights to all source files you upload and that your listings do not infringe on third-party intellectual property.
• API key security: You are responsible for the security of your Google Gemini API key and any costs incurred through its use.
• Legal compliance: You are responsible for complying with all applicable laws and regulations in your jurisdiction, including consumer protection, tax, and digital goods regulations.

4. AI-Generated Content

ShopSmith uses Google Gemini AI to generate listing content. This content is provided as a starting point and should be reviewed before use. We make no warranty that AI-generated content is:

• Accurate or factually correct
• Free from intellectual property issues
• Compliant with Etsy's policies
• Optimized for search ranking or sales performance

You should always review and edit generated content to ensure accuracy and compliance with marketplace rules.

5. No Scraping or Automation

ShopSmith does not scrape, crawl, or automate any actions on Etsy or any other website. All interaction with Etsy occurs through your browser under your manual control. ShopSmith prepares content that you copy and paste or upload manually.

6. Disclaimer of Warranties

ShopSmith is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability and fitness for a particular purpose
• Warranties that the software will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of AI-generated content
• Warranties that the software will meet your specific requirements

7. Limitation of Liability

To the maximum extent permitted by applicable law, ShopSmith and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the software.

8. Etsy Trademark Notice

The term "Etsy" is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc. All references to Etsy are for identification purposes only.

9. Data and Privacy

Your use of ShopSmith is also governed by our Privacy Policy. ShopSmith stores all data locally on your computer and does not collect personal information.
